Did Pennsylvania DUI ARD Rules Change Again?

Pennsylvania DUI law has changed more than once when it comes to ARD and future DUI sentencing. In May 2025, the Pennsylvania Supreme Court ruled that a prior DUI handled through ARD could not automatically be treated the same as a conviction for DUI sentencing enhancements. In plain English, ARD is not a conviction, so it could not be counted the same way for higher mandatory minimums.

However, Pennsylvania later passed a new law creating a separate offense called DUI following diversion. Starting in 2026, if someone is charged with another DUI within 10 years of completing ARD, that new charge may be graded and penalized differently.
